1. Agreement to Terms

These Terms of Service (“Terms”) constitute a legally binding agreement between you (“User,” “you,” or “your”) and Qubience (“Company,” “we,” “us,” or “our”) governing your access to and use of the Qubience platform, API, SDK, documentation, and any related services (collectively, the “Service”).

By accessing or using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, you must not access or use the Service. If you are using the Service on behalf of an organization, you represent and warrant that you have authority to bind that organization to these Terms.

2. Description of Service

Qubience provides a quantum error correction API service that applies Echo Circuit Pre-Compensation with Idle Zone (ECPC+IZ) corrections to quantum circuits. The Service includes:

  • API endpoints for circuit validation, error correction, and usage monitoring
  • Web-based dashboard for API key management and usage monitoring
  • Documentation and integration guides
  • SDK libraries for programmatic access

The Service processes quantum circuit descriptions (QASM format) and returns optimized circuit descriptions with virtual RZ corrections applied. The Service can optionally execute quantum circuits on third-party quantum hardware (e.g., IBM Quantum) using credentials you provide. We act as a processing layer and do not store your hardware access tokens beyond the duration of a single request.

3. Account Registration

3.1 Eligibility

You must be at least 18 years old and capable of forming a legally binding contract to use the Service. If you are using the Service on behalf of an entity, you must have authority to accept these Terms on behalf of that entity.

3.2 Account Security

You are responsible for maintaining the confidentiality of your account credentials and API keys. You agree to notify us immediately of any unauthorized use of your account. We are not liable for losses arising from unauthorized use of your credentials.

3.3 API Keys

API keys are issued to your account and must not be shared, published, or embedded in client-side code. Compromised keys should be revoked immediately via the dashboard. We reserve the right to revoke keys that are found to be publicly exposed.

4. Acceptable Use

You agree not to:

  • Use the Service for any unlawful purpose or in violation of any applicable laws
  • Attempt to reverse-engineer, decompile, or extract the algorithms or models underlying the Service
  • Circumvent rate limits, usage caps, or any technical restrictions
  • Resell, redistribute, or sublicense access to the API without written authorization
  • Submit intentionally malformed or excessively large inputs designed to degrade service performance
  • Use automated tools to scrape, crawl, or data-mine the Service beyond normal API usage
  • Impersonate another user or misrepresent your affiliation with any entity

Violation of these terms may result in immediate suspension or termination of your account without refund.

5. Subscription Plans and Billing

5.1 Plans

The Service is offered under multiple subscription tiers (Starter, Professional, Research Lab, Enterprise) with varying usage limits, features, and support levels as described on our Pricing page. Plan details are subject to change with 30 days' notice.

5.2 Payment

Paid subscriptions are billed monthly or annually in advance via Razorpay. All payments are in INR unless otherwise specified. Prices are exclusive of applicable taxes, which will be added at checkout where required by law.

5.3 Refunds

We offer a 14-day money-back guarantee for new paid subscriptions. Refund requests after this period are evaluated on a case-by-case basis. To request a refund, contact qubience@gmail.com.

5.4 Overages

Usage beyond your plan's monthly allocation will result in API requests being rejected (HTTP 429). We do not charge overage fees. You can upgrade your plan at any time to increase limits.

6. Intellectual Property

6.1 Our IP

The Service, including all algorithms, models, software, documentation, trademarks, and trade secrets, is the exclusive property of Qubience. These Terms grant you a limited, non-exclusive, non-transferable license to use the Service in accordance with your subscription plan.

6.2 Your IP

You retain all rights to your quantum circuits, measurement data, and research outputs. We claim no ownership over data you submit to or receive from the Service. By using the Service, you grant us a limited license to process your data solely for the purpose of providing the Service.

6.3 Feedback

If you provide suggestions, feature requests, or feedback about the Service, you grant us an irrevocable, perpetual, royalty-free license to use that feedback for any purpose without compensation.

7. Data Processing

Circuit data submitted to the Service is processed in-memory and not persisted. We store only:

  • Account information (email, name, plan)
  • Usage metadata (API call counts, timestamps, qubit counts)
  • Payment records as required by financial regulations

We do not store, log, or retain your quantum circuits, calibration data, or optimization results beyond the duration of a single request. See our Privacy Policy for details.

8. Service Level and Availability

We strive to maintain high availability but do not guarantee uninterrupted service for non-Enterprise plans. Planned maintenance will be communicated at least 72 hours in advance. Enterprise customers receive formal SLA commitments as specified in their service agreement.

The accuracy of quantum error corrections depends on hardware conditions and is provided on an “as-is” basis. We do not guarantee specific fidelity improvement levels, as results vary by hardware, circuit depth, and noise characteristics.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, Qubience SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, RESEARCH RESULTS, BUSINESS OPPORTUNITIES, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE.

Our total aggregate liability for any claims arising under these Terms shall not exceed the amount you paid to us in the twelve (12) months preceding the claim.

10. Disclaimers

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that the Service will meet your specific requirements, achieve particular fidelity improvements, or be compatible with all quantum hardware configurations.

11. Termination

Either party may terminate this agreement at any time. You may close your account via the dashboard or by contacting support. We may suspend or terminate your access if you violate these Terms, fail to pay, or if required by law.

Upon termination, your API keys will be revoked and access to the Service will cease immediately. We will retain account data as required by law and delete it within 90 days of your request.

12. Modifications

We may update these Terms at any time. Material changes will be communicated via email at least 30 days before taking effect. Your continued use of the Service after changes take effect constitutes acceptance of the updated Terms.

13. Governing Law

These Terms are governed by the laws of India. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts of Bengaluru, Karnataka, India.
